Welcome to Radiance. These Terms of Service and Privacy Policy govern your access to and use of the Radiance mobile applications, websites, web applications, APIs, content libraries, and related services (collectively, the “Service”).



By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility


You must be at least 13 years old to use the Service.



If you are under the age of majority in your jurisdiction, you represent that you have permission from a parent or legal guardian to use the Service.

2. Ownership of Content



All wallpapers, artwork, graphics, images, illustrations, metadata, collections, application designs, branding, software, source code, user interface elements, and related content made available through the Service are owned by Radiance, its licensors, content partners, or creators.



Your use of the Service does not grant you ownership of any content or intellectual property rights.



All rights not expressly granted are reserved.

3. Limited License



Radiance grants you a limited, non-exclusive, non-transferable, revocable license to:



* Access and browse content through the Service.

* Download wallpapers for personal use where expressly permitted.

* Use features of the Service in accordance with these Terms.



This license may be modified, restricted, or revoked at any time.


4. Prohibited Uses


You may not:



* Copy, reproduce, distribute, republish, resell, sublicense, or commercially exploit content from the Service without permission.

* Create competing wallpaper libraries, applications, websites, or services using content obtained from Radiance.

* Archive substantial portions of the Service.

* Mirror or replicate the Service on another platform.

* Remove copyright notices, trademarks, watermarks, or attribution.

* Circumvent technical protections or access controls.

* Access content through unauthorized means.

* Use the Service in any manner that violates applicable laws or regulations.



Content Protection



Users may not access, collect, download, export, reproduce, cache, archive, index, mirror, aggregate, or otherwise copy a substantial portion of the Radiance catalog, whether manually or through automated means.



Users may not create or assist in creating any competing product, service, dataset, search engine, wallpaper library, content archive, recommendation system, or AI training corpus using content or data obtained from Radiance.



Radiance reserves the right to implement technical measures to detect, prevent, and block unauthorized collection of content and metadata.


5. Automated Access Restrictions



Except where expressly authorized in writing by Radiance, you may not:



* Scrape content.

* Crawl content.

* Harvest metadata.

* Download content in bulk.

* Use bots to collect images.

* Use automated systems to access large portions of the Service.

* Build datasets from Radiance content.

* Extract creator information, collections, or catalog data at scale.



Attempts to systematically retrieve, replicate, reconstruct, or reproduce the Radiance catalog are prohibited.



Radiance reserves the right to suspend access, block IP addresses, terminate accounts, and pursue legal remedies for unauthorized automated access.

6. Artificial Intelligence Restrictions



Without prior written authorization from Radiance, you may not:



* Use Radiance content to train artificial intelligence systems.

* Create datasets from Radiance content.

* Use Radiance content for machine learning development.

* Use automated systems to collect content for AI training.

* Generate derivative databases using Radiance content or metadata.

* Fine-tune, train, evaluate, benchmark, or improve machine learning models using content obtained from the Service.



These restrictions apply regardless of whether access occurs manually, programmatically, or through automated systems.


7. API and Data Access



If Radiance provides APIs, feeds, developer tools, or integrations, use of those services may be subject to additional terms.



Unauthorized access to internal systems, databases, APIs, infrastructure, servers, or administrative tools is prohibited.



Reverse Engineering Restrictions



Users may not:



* Reverse engineer the Service.

* Attempt to discover source code.

* Circumvent security measures.

* Bypass rate limits.

* Interfere with infrastructure.

* Probe, scan, or test vulnerabilities without written authorization.

* Attempt to access restricted areas of the Service.


8. User Accounts



You are responsible for maintaining the confidentiality and security of your account credentials.



You are responsible for all activity that occurs under your account.



Radiance may suspend, restrict, or terminate accounts that violate these Terms.


9. Service Availability



Radiance may modify, suspend, discontinue, remove, or replace any feature, content, service, or functionality at any time without notice.



We do not guarantee uninterrupted availability, uptime, or access to the Service.


10. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”



TO THE MAXIMUM EXTENT PERMITTED BY LAW, RADIANCE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY.



RADIANCE DOES NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.


11. Limitation of Liability



TO THE MAXIMUM EXTENT PERMITTED BY LAW, RADIANCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE USE OF THE SERVICE.



IN NO EVENT SHALL RADIANCE’S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY THE USER TO RADIANCE DURING THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.


12. Privacy Policy

Account Termination



Radiance may suspend or permanently terminate access without notice if it reasonably believes a user has engaged in:

* Abuse of the Service.

* Attempts to circumvent technical protections.

14. Governing Law



These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.



Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Texas.



By using the Service, you consent to the jurisdiction of such courts.


By accessing or using Radiance, you acknowledge that you have read, understood, and agreed to these Terms of Service and Privacy Policy.

We may update this Privacy Policy from time to time. Updates will always be posted here with a new effective date.
